Gràcies a l’aposta tecnològica de les societats actuals i també a la globalització que comporta, el moviment transhumanista, visiblement heterogeni, està començant a ser conegut a tot el globus terraqüi i a adquirir una enorme volada. Això no obstant, malgrat que la materialització de les fites transhumanistes només sigui possible en les societats postmodernes, l’origen del transhumanisme bé pot anar més enllà del que anomenem societat contemporània. Few emotions have divided opinion as deeply as shame. Some scholars have argued that shame is essentially a maladaptive emotion used to oppress minorities and reinforce stigmas and traumas, an emotion that leaves the self at the mercy of powerful others. Other scholars, however, have argued that the absence of a sense of shame in a subject--their shamelessness--is tantamount to a vicious moral insensitivity. As the twelve original chapters in this collection attest, however, shame scholars are entering a new phase, (...) one in which scholarship no longer attempts to defend one side of shame against the other, but rather accepts both faces as faithful to the phenomenon to be explained. At the core of our understanding of shame there are profound disagreements about the importance of the Other in shaping our moral identity. Let ‘semantic relevance’ be the thesis that the wide semantic properties of representational mental states (like beliefs and desires) are causally relevant to behavior. A popular way of arguing for semantic relevance runs as follows: start with a sufficient counterfactual condition for causal or explanatory relevance, and show that wide semantic properties meet it with respect to behavior (e.g., Loewer & Lepore (1987,1989), Rescorla (2014), Yablo (2003)).This paper discusses an in‐principle limitation of this strategy: even the most sophisticated counterfactual criteria (...) systematically misclassify irrelevant properties as relevant when they stand in certain kinds of modal co‐variation or ‘entanglement’ relations to genuinely relevant properties. This entanglement problem, I argue, is more general and more serious than proponents of the counterfactual strategy have recognized: it threatens recent interventionist arguments for semantic relevance, and is not easily solved by appeal to proportionality or naturalness. I end by suggesting that proponents of semantic relevance may need to shift their attention from patterns of counterfactuals to the lawful psychological generalizations that explain them. (shrink)

In recent years, character traits in general and virtue-related concepts in particular have been of considerable interest to philosophers, psychological researchers, and practitioners in the business ethics field. Three approaches to character traits can be used to incorporate ethics into organizations: virtues, character strengths, and competencies. The aim of this article is to clarify the concept of character traits, or virtues, and provide a unified operational version of it for incorporation into management. To this end, we first discuss the analogy (...) among virtues, character strengths, and competencies. Current frameworks on ethical decision-making process have some limitations. This paper argues that the consideration of moral competencies, understood as moral virtues in the workplace, can enhance our understanding of why moral character contributes to ethical decision-making. After discussing the universal nature of four moral competencies (prudence, justice, fortitude and temperance), we analyse their influence on the various stages of the ethical decision-making process. We conclude by considering the managerial implications of our findings and proposing further research.

This paper explores various notions of aesthetic affordance recently developed through embodied, situated and enactive approaches to aesthetic experience by Maria Brincker and Shaun Gallagher, and the similarities and differences between them and the idea of affective affordance put forward by Joel Krueger and Giovanna Colombetti. This discussion is a way to try to offer some answers to the question of what aesthetic affordances particularly afford compared to affective affordances. I will focus on the affordances that we perceive during various (...) aesthetic experiences in which we find ourselves more moved by the object, event or person(s) causing the experience than we had anticipated. I will argue that these experiences emerge as opportunities to carry out an active exploration of aspects of the narrative self that we feel is related to features of the experience; and that one particular brain network likely to be involved in these experiences – i.e. the default network – might help us to understand how these experiences meaningfully change our relationship with ourselves and with the social context of which we are a part. I offer a phenomenological description of undocumented immigrant reason, provisionally understood as a sort of historical reason grounded on undocumented immigrant life. That is, the categories of undocumented immigrant reason are resources for undocumented immigrant existence and are inscribed in the historical memory of immigration (they are shared and communal), accessed by immigrants in stories, anecdotes, and interpersonal trauma. Abstracting from personal experience, testimony, popular culture, and elsewhere, I propose a fragmentary list of these categories of undocumented immigrant reason, a (...) list that includes journeying, crossing/nepantla, uncertainty/zozobra, nostalgia, and return. These categories, which structure undocumented immigrant reason, are reflected in beliefs and attitudes about migration, belonging, the contingency of life, the centrality of memory, and the meaning of death. Constitutive of immigrant rationality are beliefs and ways of being that lend meaning to immigrant life, including those beliefs and ways of being that place immigrants in closer proximity to fundamental human truths. The standard view in current philosophy of creativity says that being creative has two requirements: being novel and being valuable. The standard view on creativity has recently become an object of critical scrutiny. Hills and Bird have specifically proposed to remove the value requirement from the definition, as it is not clear that creative objects are necessarily valuable or creative people necessarily praiseworthy. In this paper, I argue against Hills and Bird, since eliminating the element of value from the explanation (...) of creativity hinders the understanding of the role that creative products play in actual epistemic practices, which are fundamentally normative. More specifically, I argue that the terms ‘creativity’ and ‘creative’ function as thick epistemic concepts when employed by competent epistemic agents in practice, that is, these concepts have both a descriptive and an evaluative content that cannot be disentangled from one another. Accordingly, I suggest that philosophers should prefer thick accounts over thin accounts of creativity. A thick account of creativity is one that endorses the standard view at its basis, but further develops it in two ways: by stressing the entanglement of the value and novelty requirements; by permitting to encompass a range of domain-specific characterizations of such entanglement for different epistemic situations. In order to take the first steps in the development of such a thick account of creativity, I look at the domain of scientific practices as a case in point, and try to spell out what the thickness of creative instances typically entails here. Namely, I identify the worthy novelty of creative models and methods with their potential to clarify a tradition, with fruitfulness, and with the fulfilment of exploratory aims. (shrink)

The relationship between social and financial performance (CSP – FP) has been a main objective in the literature on business management, as it would provide an economic justification for the social investment insofar as it contributes to the creation of value. This relationship has been empirically tested by several authors though without using a theoretical model that sustains this relationship. The aim of this article is to propose a theoretical model of the process of the creation of value from the (...) reputation generated by companies, integrating the factors that have been shown to be more relevant in this process from previous research, in such a way that hypotheses are put forward regarding the existence of this relationship and the factors that determine it. The current literature shows great interest in the issue of gender diversity on boards of directors. Some studies have hypothesized a direct relationship between diversity and the value of the firm, but not many examine the intermediate mechanisms that may exert an influence on such relationships. We employ two stages of GMM estimation methodology to exhibit evidences of the relationship between gender diversity and compensation of top managers in the Spanish context. Results show that gender diversity positively affects the effectiveness (...) of boards—in terms of composition, structure, size and functioning—influencing a proper design of top managers compensation linked to company performance. Evidences suggest that legislative actions aimed at increasing the presence of women on boards of directors are justified not only for ethical reasons, but also for reasons of economic efficiency. The focus of this paper is Mexican historicism. It has three objectives: first, to introduce English-speaking readers to the nature and history of Mexican historicism; second, to defend Mexican historicism against the charges of relativism usually raised against historicism in general and “Mexican” philosophy in particular; and third, to argue for what I call the transcendental, or alternatively, “liberatory,” nature of Mexican historicism—a nature with philosophical and political consequences. The hope is that by making the clarifications and determinations made here, (...) the tradition of Mexican philosophy, of which Mexican historicism is a key moment, may find its place in the increasingly pluralistic US philosophical landscape. Purpose The purpose of this paper is to lay out an approach to addressing the problem of privacy protection in the global digital environment based on the importance that information has to improve users’ informational self-determination. Following this reasoning, this paper focuses on the suitable way to provide user with the correct amount of information they may need to maintain a desirable grade of autonomy as far as their privacy protection is concerned and decide whether or not to put their (...) personal data on the internet. Design/methodology/approach The authors arrive at this point in their analysis by qualitative discourse analysis of the most relevant scientific papers and dossiers relating to privacy protection. Findings The goal of this paper is twofold. The first is to illustrate the importance of privacy by default and informed consent working together to protect information and communication technology users’ privacy. The second goal is to develop a suitable way to administrate the mentioned “informed consent” to users. Originality/value To fulfil this purpose, the authors present a new concept of informed consent: active “informed consent” or “Opt-in” model by layers. “Opt-in” regimens have already been used with cookies but never with 2.0 applications, as, for instance, social network sites. First in-depth analysis of this important Mexican philosopher’s work.

In the last decade, the migrant population in Chile has substantially increased, where the rates have not only increased in the adult population, but also among children and adolescents, creating a potential for social and cultural development in the educational system. The present work analyzes the relationship between self-concept, self-efficacy, and subjective well-being in native and migrant adolescents in Santiago de Chile. The sample consisted of 406 students, 56.65% women, with an age range that fluctuated between 12 and 16 years, (...) with an average of 13.36 years. Student’s t-tests were used to compare the average of the constructs evaluated between natives/migrants and boys/girls participants. Subsequently, two multivariate models of simple mediation were constructed, one for natives and another for migrants, which assumed subjective well-being as a dependent variable, academic self-concept as an independent variable and the general self-efficacy as a mediating variable. In both models, gender was considered as a control variable. Results show that migrant students present higher levels of academic self-concept and general self-efficacy than native students. There are no differences with regard to well-being. In the case of gender, differences are observed only for the case of general self-efficacy, where boys present higher levels. On the other hand, a partial mediation is observed for the model of native students and a total mediation for the model of migrant students. The study yielded interesting results regarding the differences in the evaluation of the constructs of self-concept, self-efficacy, and subjective well-being in both groups. Such data can be used as inputs for the development of public policies for adolescents. (shrink)

El proceso de toma de decisiones jurídicas se está optimizando con herramientas de inteligencia artificial (...) que buscan y analizan jurisprudencia, gestionan casos y realizan análisis predictivos. Sin embargo, es crucial abordar los desafíos éticos, asegurando la transparencia, la equidad y la responsabilidad en los sistemas automatizados. Las tecnologías emergentes prometen realizar análisis más complejos y adaptarse a nuevas situaciones legales, pero su implementación debe ser regulada para garantizar una justicia imparcial y accesible. This paper argues for a broad definition of philosophical sources and how Indigenous traditional knowledge fits that definition. It concludes by showing how, following the previous two points, an Indigenous document such as the Huarochirí Manuscript can be considered a philosophical source by academic philosophers. The paper has three sections: the first deals with the methodological point of addressing what can be considered as philosophy. This section presents a conversational approach to philosophy. This approach, although broad, properly captures the practices (...) of inquiring about philosophical issues as is commonly done in Western academic circles, but without excluding the practices of non-Western cultures from being labelled as philosophical. The second section argues for the analytical distinction between a philosophical source, a philosophical text, and a philosophical insight. It shows that what makes a philosophical source such are the philosophical insights that it can provide. The final section shows how the Huarochirí Manuscript has merits making it worthy of being considered a philosophical source and thus a relevant academic source for those working in the field of philosophy. Charles Peirce is widely credited as the originator of semiotics, or the general theory of signs, and recognized as the founder of American pragmatism, albeit in that peculiar kind Peirce himself went on to distinguish as “pragmaticism.” The semiotic and pragmatist strands in Peirce’s thought come together in an appraisal of scientific diagrammatic representations. Peirce’s pragmatic maxim entails that the consequences of a sign inform our entire conception of the sign, while his most considered semiotic system entails that a complex (...) sign partakes of iconic, indexical, and symbolic aspects. We illustrate Peirce’s insights by means of the celebrated Feynman Diagrams in Quantum Electrodynamics. We argue that Peirce’s late, post-1903, semiotics provides an adequate characterization of such “hypoicons,” and his pragmatic maxim explains how they can motivate and drive inquiry. We conclude that Peirce’s pragmatic approach to scientific diagrams remains a viable position that skillfully avoids dogmatic scientism and nihilistic skepticism alike. (shrink)

I introduce a novel multidimensional framework tailored to investigate a set of phenomena that might appear intractable and render them amenable to scientific inquiry. In particular, I focus on examining altered states of consciousness that appear to the experiencing subject as “contentless” or “objectless” states in some form, either by having disrupted or reduced content of awareness, or content that appears as missing altogether. By drawing on empirical research, I propose a cluster of phenomenological dimensions aimed at enhancing our understanding (...) of this group of experiences of minimal awareness, including Richness of the Content, Bodily-Awareness, Passage of Time, Attentional Focus, and Self-Revelation. The result is a robust framework that provides precise scientific terminology, facilitating its operationalisation and adaptability for future empirical work. I show the explanatory power of this framework through a case study of the state of clear light sleep—a state widely reported by Indo-Tibetan Buddhist traditions as an instance of pure awareness during sleep, a state of consciousness-as-such. This rare phenomenon has gained increasing attention in contemporary analytic philosophy of mind for the study of the nature of consciousness. However, we still lack consensus on its characterisation and potential identity with other associated states. I end the paper by illustrating how the state of clear light sleep can be situated in relation to other associated states and more ordinary ones as regions of a multidimensional state space. This study examines the cultural roots of ethical conflicts in the global business environment. It begins with a brief look at worldviews on ethical behavior in general. Based on this, it is argued that an in-depth understanding of ethical conflicts has been hampered by an overreliance on Western models and viewpoints. Three common sources, or bases, of ethical conflicts are discussed as they relate to business practices, including conflicts over tastes and preferences, the relative importance of moral imperatives compared to (...) legal requirements, and people’s level of tolerance for different values among others. It is then argued that an understanding of ethical conflicts can be facilitated through different levels of understanding, including the meaning of universal values, the relationship between values and practices, and the existence of multiple levels of conflict within the same organizations or industries. These specific and interrelated ingredients in cross-cultural ethical conflicts form the basis for a broader discussion of the meaning of truth as it relates to such conflicts. The paper concludes with the need for more research that is cross-cultural and multidisciplinary in order to improve theory building and managerial practice. (shrink)

“Conciencia”, la sección inicial de la Fenomenología de Hegel, se ocupa de la comprensión del mundo físico que nos rodea. La sección siguiente, “Autoconciencia”, comienza a considerar nuestra comprensión de nosotros mismos y de los otros. Este orden de discusión no es ni arbitrario ni meramente conveniente. Por el contrario, una de las principales lecciones que hemos de aprender hacia el final del desarrollo de la “conciencia” es que nuestra mejor concepción del mundo que es el objeto de nuestras actividades (...) cognitivas es inteligible solo como una parte de un relato que además considera la naturaleza del sujeto que se dedica a tales actividades. La razón para esta transición expositiva es un aspecto importante en el idealismo de Hegel. En este capítulo ofrezco una reconstrucción racional de un argumento que veo como el soporte de esta transición y del tipo de idealismo que esta implica. (shrink)

The foundation of morality, and mainly, the possibility of moral sentiments that are universal and inalienable, is a central problem in Maine de Biran’s philosophy. Many studies focus on the part played by the self in Maine de Biran’s late philosophy, but relatively few consider with precision the importance of the concept of sympathy in this context. In this paper, I would like to show that this concept, which Biran mobilizes from his first to his last writings, is an important (...) conceptual resource in his enterprise of founding morality. I will draw on three main texts that cover almost the entire period in which he wrote, namely, his Mémoire sur l’influence de l’habitude sur la faculté de penser ([1802] 1987), his Mémoire sur les perceptions obscures ou sur les impressions générales affectives et les sympathies en particulier ([1807] 1984), and his Fragments relatifs aux fondements de la morale et de la religion ([1819] 1859). The main finding is that sympathy occupies a central place in this enterprise of moral foundation but undergoes profound and almost contradictory conceptual re-elaborations throughout Biran’s intellectual journey. Although in his first philosophical texts Biran concentrates on the fundamental dimension of organic sympathy, he rejects it almost entirely in his last texts in favor of an analysis of the sympathy between the selves. When must a specific cognitive habit be called upon to solve a problem? In the subject’s learning process, “knowing-to” is connected with a conscious particular judgment of truth or “aha” moment enacting a new behavioral schema. This paper comments on recent experiments supporting the view that a shift from automatic to controlled forms of inhibition, involving conscious attention, is crucial for detecting errors and activating a new strategy in complex cognitive situations. The part that consciousness plays in this process agrees (...) with its philosophical description as “judge of truth”, and can thus be regarded as an essential precursor to the development of higher cognitive habits. In this regard, John Henry Newman’s explanation of human assent to truth, for which our consciousness of self is always prior, proves to be decisive. (shrink)

The Epistemological Turn of the Twentieth Century’s Legal Positivism This article analyses the essential changes in the positivist law theory from its modern origins, usually remitted to Hobbes, Bentham and Austin, to the positivism of Kelsen and Hart. It is argued that a crucial epistemological break can be noticed, revealed in the most analytic-rationalistic character of Kelsen and Hart’s elaborations, compared to the more facts-descriptive style of their predecessors. Rationalism in Kelsen and Hart may explain the conventional character of the (...) basic norm and the rule of recognition, validity only formally, and the difficulty of accounting for the formal and substantive components. The change can be associated with Kelsen and Hart’s intellectual context, particularly Hume’s ‘guillotine’, the influences of logical positivism and neo-Kantian schools. This turn should not be overlooked since it casts doubts on the usual speaking of Kelsen and Hart’s legal positivism in the descriptive sense of nineteenth-century philosophers, with relevant consequences for thinking of law. Sin embargo, su comprensión es de alta complejidad puesto que exige un próvido examen de otros conceptos que entran en relación con ellos. Dado que hoy contamos con la teoría de modelos, una teoría matemática con aplicaciones en lógica, debería ser bastante útil utilizar su marco teórico para comprender el Tractatus. La modernidad se caracteriza por una epistemología que ha conducido a la separación de los saberes. Como consecuencia, tanto la teología protestante como la católica han sufrido la falta de una perspectiva unitaria en su razonar sobre Dios. La cultura postmoderna, aceptando la fragmentariedad, presenta una nueva sensibilidad epistemológica que abre posibilidades prometedoras para el redescubrimiento de la trascendencia. Entre ellas, la dialogicidad intrínseca de la Creación apunta a la vía de la belleza como camino privilegiado que la teología ha (...) de explorar en un sentido descendente y, especialmente, ascendente. En este trabajo se parte de una lectura interdisciplinar y crítica de los distintos actores y perspectivas que intervienen en la investigación baudelairiana, enfatizando la relación existente entre música y poesía. El conocimiento musical y la pasión por la música de Charles Baudelaire están presentes en su obra, en la que tanto citas directas como alusiones resultan esenciales para el develamiento y la comprensión de su yo poético. No obstante, es en el ámbito de la filosofía donde música y poesía (...) van a encontrarse conciliándose, ya que ambas artes no solo se ven arrastradas naturalmente a la reflexión filosófica, sino que, al igual que la poesía genera “ideas”, la música, por sí misma, compone “ideas-melodías”. The Shroud of Turin is an old linen fabric imprinted with the image of a tortured man who lies prone with his hands crossed before him. Since for many it is related to Jesus of Nazareth, this cloth is among the most studied, controversial and enigmatic of all archaeological and religious objects. Since its radiocarbon dating at the end of the eighties of the last century, it is considered by many to be an object made in the Middle Ages. The (...) controversy is due to the fact that there are other scientific and artistic evidences that place this object outside the medieval sphere. An argument map is a critical thinking way of representing the relationships between evidences and arguments, and is used here to represent the sequences of argumentation that defend that the Shroud of Turin is not a medieval object. En este artículo se analiza un conjunto de obras sobre ríos y represas que pertenece a la serie titulada Represa /Represión (2012-) de la artista colombiana Carolina Caycedo. La pregunta de la que se ocupa esta investigación es ¿cómo las estrategias estéticas de estas obras identifican los problemas socio-ecológicos generados por las represas y contribuyen a articular imaginarios políticos de sostenibilidad? El argumento principal es que las obras de Caycedo sobre el río Yuma o Magdalena contribuyen con la construcción de (...) una memoria histórica ambiental, a partir de saberes populares, campesinos y cosmovisiones indígenas. Con este fin, este texto caracteriza el problema de las represas a partir de los conceptos de ‘extractivismo’, de Macarena Gómez-Barris, y ‘desterritorialización’, de Rob Nixon, para luego realizar un recorrido por las obras de la artista, de cuyo análisis se va construyendo una caracterización de la memoria histórica ambiental de un segmento del río Yuma. El marco conceptual del trabajo incluye las nociones de ‘seres-tierra’, de Marisol de la Cadena y ‘territorio’, de Arturo Escobar, así como ‘memoria de los ríos’, de Kristina Lyons. La metodología se basa en el análisis conceptual y técnico de las piezas de Caycedo en el marco interdisciplinar de las humanidades ambientales. Since the mid-1940s, when Maurice Merleau-Ponty gave a lecture on cinema at the Institut des Hautes Études Cinématographiques (IDHEC) in Paris, which was later published as “Cinema and the New Psychology” (Merleau-Ponty, 1977, pp. 89-105), film scholars have shown a lively interest in the relationship between philosophy and the seventh art. During his lifetime, his thinking influenced a number of important film theorists, from Amédée Ayfre, who was his student, to André Bazin to Henri Agel. More recently, in an Anglophone (...) context, and largely thanks to the pioneering work of Vivian Sobchack, his phenomenology has been a source of inspiration for thinking about the cinematic experience as an embodied vision, involving a deep exploration of perception. My own aim in this text is to encourage a slight but significant shift in focus as I explore what can be learned from Merleau-Ponty about the imagination, and ask how this might improve the understanding of film, particularly documentary film. Merleau-Ponty makes only passing reference to the work of the modernist film movements of the early 20th century in his own writings on film, but his phenomenology is relevant to understanding films made at a later date that engage with modernist discourse in a broadest sense. Habermas’s translation proviso aims to legitimize religious argumentation in the informal part of the public sphere while requiring religious citizens to express their arguments in the formal part of the public sphere using a universal (secular) language. By considering secular scholars Gonzalo Scivoletto’s and Javier Aguirre’s critiques of the meaning of “translation,” this article highlights the inconsistency of the proviso as manifested in its application to the religious concept of tzimtzum (“divine contraction”), from which Habermas attempts to extract a secular (...) worldview and moral intuitions that contradict the beliefs of religious citizens, thus undermining the reassessment of religion in the public sphere.
